GST57th GST Council: arrest power to go, prosecution threshold ₹5 crore, automatic refunds and wider input tax credit recommended
Prosecution: ₹1 crore → ₹5 croreReliefThe GST Council, in its 57th meeting on 8 October 2026, recommended omitting the arrest power in section 69 of the CGST Act, raising the prosecution threshold from ₹1 crore to ₹5 crore and cutting the general penalty from ₹25,000 to ₹10,000. It also recommended system-sanctioned refunds, refund of credit on capital goods and input services, a shorter list of blocked credits and a simpler registration for small e-commerce sellers. None of it is law yet: each item needs a circular, notification or amendment.

₹10 lakh penalty on RapidoThe Central Consumer Protection Authority has imposed a ₹10 lakh penalty on Roppen Transportation Services Private Limited, which operates Rapido, for misleading advertisements, unfair trade practices, unfair contract and dark patterns. Prompts asking riders to add to the fare before a ride was confirmed were held to be “confirm shaming”, and the colour-coded price slider “interface interference”.

Penalty: 2% or ₹2 lakh, lowerReliefSEBI has revised the penal provisions for open-interest violations at client level in the commodity derivatives segment: the penalty is 2% of the value of the excess for the days it continues, or ₹2,00,000 (₹10,000 where the excess is up to 2% of the limit), whichever is lower. No additional penalty applies where the breach arises only from clubbing. The definition of “Broad Commodity” and client position limits are also revised.

CCI: cease and desist, no penaltyBy an order dated 2 September 2026 under section 27 of the Competition Act, 2002, CCI has directed Trustees’ Association of India, IDBI Trusteeship Services Limited, Axis Trustee Services Limited and SBI CAP Trustee Company Limited to cease and desist from conduct found to violate section 3(3)(a) and 3(3)(b) read with section 3(1). No monetary penalty was imposed.

₹10 lakh penalty on Dial4TradeThe Central Consumer Protection Authority has imposed a ₹10 lakh penalty on Dial4Trade Technologies Private Limited for facilitating the online listing, advertising and sale of ammonium nitrate without the mandatory safeguards, and directed it to stop listing any substance classified as an explosive under the Explosives Act, 1884. Seven other platforms are under examination.

LoA renewal: 2 months beforeAction neededIFSCA has directed every regulated entity in the IFSC to hold a valid and subsisting Letter of Approval under the SEZ Act, 2005 and the applicable IFSCA registration, licence or authorisation at all times, and not to do business without them. It notes that some entities are operating without these. The circular supersedes the direction of 3 April 2025.
