Design registration in India — at a glance
Registering an industrial design under the Designs Act, 2000 protects the visual appearance of a product — its shape, configuration, pattern, ornament or composition of lines and colours — not its function. Protection lasts 10 years, extendable by a further 5 years on renewal. To be registrable the design must be new and original.
Government fee by applicant category
The official fee for filing a design application (Form 1) depends on who the applicant is. Natural persons, DPIIT-recognised startups and small entities pay a concessional rate; companies and large entities pay the standard rate. Fees are charged per design, per class.
| Form 1 — application to register a design | ₹1,000 |
| TaxClue professional fee | ₹4,999 |
| Total per design | ₹5,999 |
| Form 1 — application to register a design | ₹4,000 |
| TaxClue professional fee | ₹4,999 |
| Total per design | ₹8,999 |
How the cost is calculated
Total cost = (government fee for your category + professional fee) × number of designs. Government fee is ₹1,000 (individual / startup / small) or ₹4,000 (company / large); professional fee is a flat ₹4,999 per design. Here are three worked examples:
Key terms explained
What a design protects
A registered design protects the visual appearance of a product — its shape, configuration, surface pattern and ornamentation. It does not protect how the article works; that is the domain of patents.
Novelty requirement
The design must be new and original and not previously published or used anywhere in India or abroad. Prior disclosure — even your own — can destroy novelty, so file before you launch.
Term & renewal
Protection runs for 10 years from registration and can be extended once by a further 5 years, giving a maximum of 15 years. Renewal must be applied for before the initial term expires.
Locarno classification
Every design is filed under a class of the Locarno classification, an international system that groups articles by type. The same design in multiple classes needs a separate application and fee for each.
