Government fee — ₹4,500 vs ₹9,000 per class
The IP India government fee for filing a trademark online is ₹4,500 per class for an individual, startup or MSME (with a valid Udyam / startup certificate), and ₹9,000 per class for a company, LLP or partnership firm. This fee is charged per class, per application — so a company filing in two classes pays ₹18,000 in government fees alone, before any professional charges.
What is a trademark class?
India follows the NICE classification of goods and services — 45 classes in total (classes 1–34 for goods, 35–45 for services). Your trademark is only protected in the classes you register it in. A software brand that also runs training programmes, for example, may need class 42 (IT services) and class 41 (education). Each additional class is a separate government fee, which is why the calculator charges the fee per class.
One class ≠ full protection
Registering in class 25 (clothing) does not stop someone using your name on class 3 (cosmetics). Pick every class your business actually operates in.
Individual / MSME discount
The ₹4,500 concessional fee needs a valid Udyam registration or DPIIT startup recognition. Without it, even a sole proprietor is charged at the ₹9,000 company rate.
Search before you file
A trademark search checks the register for conflicting marks. Filing a mark that clashes wastes the government fee — it is non-refundable if the application is rejected.
Expedited examination
Paying the ₹20,000/class expedited fee moves examination to the front of the queue — first response in about 3 months instead of 12–18.
Timeline & the ™ vs ® difference
A straightforward, unopposed trademark takes roughly 18–24 months from filing to registration (formality check → examination → publication in the journal → registration). Expedited examination can compress this to around 8 months. You can use the ™ symbol immediately on filing; the ® symbol may only be used once the mark is actually registered and granted.
™ — use from day one
The ™ mark signals you claim rights in a brand. It can be used the moment you file — or even before — and needs no registration. It offers weaker, common-law protection only.
® — registered only
The ® symbol is legally reserved for registered trademarks. Using ® on an unregistered mark is an offence. Once granted, ® gives you a strong statutory monopoly for 10 years, renewable.
