Rule 83A explained: this guide covers what it means, who it applies to, the step-by-step process, documents required, fees, due dates and penalties in India — so you can stay compliant with confidence and avoid costly mistakes.
Rule 83A of the Central Goods and Services Tax Rules, 2017 deals with the examination that certain enrolled goods and services tax practitioners must pass. It names the body that conducts the examination, how often, how a candidate registers, how many attempts are allowed, the qualifying marks, what counts as unfair means and how results and complaints are handled. It ends with a pattern and syllabus in Annexure-A.
This article follows the CGST Rules, 2017 as amended up to 31 October 2025 in the compilation consulted; notifications issued after that date should be checked.
Rule 83A applies to a person who is enrolled as a practitioner under rule 83(2) on the strength of clause (b) of rule 83(1) (enrolment as a sales tax practitioner or tax return preparer under the existing law). That person must pass the examination conducted by NACIN, twice in a year, as a Computer Based Test of Multiple Choice Questions, and must secure fifty per cent. of the total marks, within the period in the second proviso to rule 83(3). The fee is as specified by NACIN; the rule prints no amount.
Where the rule sits
Rule 83A was inserted by Notification No. 60/2018-Central Tax dated 30.10.2018, as its footnote records. It works with rule 83 of the CGST Rules, 2017, which governs enrolment, and with section 48 of the Act: see section 48 of the CGST Act. A practitioner who passes the examination continues to be authorised by registered persons in the usual way, and a registered person looking for support with returns can use our GST return filing service alongside such a practitioner.
Rule 83A(1) and (2): who must pass and who conducts
Under sub-rule (1), every person referred to in clause (b) of rule 83(1) who is enrolled under rule 83(2) "shall pass an examination as per sub-rule (3) of the said rule". Rule 83(3) is where the provisos on the examination sit. Under sub-rule (2), the National Academy of Customs, Indirect Taxes and Narcotics ("NACIN") conducts the examination. Clause (b) of the Explanation says that NACIN "means as notified by notification No. 24/2018-Central Tax, dated 28.05.2018".
Rule 83A(3) to (5): frequency, registration, fee and centres
- Frequency (sub-rule 3). The examination is conducted twice in a year as per the schedule published by NACIN every year on the official websites of the Board, NACIN, the common portal, the GST Council Secretariat and in the leading English and regional newspapers.
- Registration and fee (sub-rule 4). A person required to pass the examination registers online on a website specified by NACIN, and pays the examination fee "as specified by NACIN". The amount and the manner of payment are specified by NACIN on the official websites of the Board, NACIN and the common portal. The rule prints no amount, so check NACIN's announcement.
- Centres (sub-rule 5). The examination is held across India at designated centres, and the candidate may choose from the list of centres provided by NACIN at the time of registration.
Rule 83A(6): the period and the attempts
Clause (i), as substituted (the footnote records Notification No. 49/2019-Central Tax dated 09.10.2019), says that every person referred to in clause (b) of rule 83(1) who is enrolled under rule 83(2) is required to pass the examination "within the period as specified in the second proviso of sub-rule (3)" of rule 83. That proviso, in rule 83 as printed, is the period of thirty months from the appointed date.
- Clause (ii). The person may avail of any number of attempts, but all within the period in clause (i).
- Clause (iii). He registers and pays the requisite fee every time he intends to appear.
- Clause (iv). If a practitioner who has applied is prevented from availing one or more attempts "due to unforeseen circumstances such as critical illness, accident or natural calamity", he may make a request in writing to the jurisdictional Commissioner for one additional attempt, within thirty days of conduct of the examination. NACIN may consider such requests on merits based on the recommendations of the jurisdictional Commissioner.
Rule 83A(7) to (9): nature, marks and guidelines
- Nature of examination (sub-rule 7). A Computer Based Test with one question paper of Multiple Choice Questions. The pattern and syllabus are in Annexure-A.
- Qualifying marks (sub-rule 8). A person must secure fifty per cent. of the total marks.
- Guidelines (sub-rule 9). NACIN issues examination guidelines covering the procedure of registration, payment of fee, nature of identity documents, provision of admit card, manner of reporting at the centre, prohibition on possession of certain items in the centre, and the procedure of making representation and the manner of its disposal. Clause (ii) gives an illustrative list of unfair means or practices: obtaining support for candidature by any means; impersonating; submitting fabricated documents; resorting to any unfair means or practices in connection with the examination or its result; possession of any paper, book, note or other material not permitted in the centre; communicating with others or exchanging calculators, chits or papers; misbehaving in the centre; tampering with the hardware or software deployed; and attempting to commit or abet any of these.
Rule 83A(10) to (13): disqualification, results, representation and relaxation
- Disqualification (sub-rule 10). If a person is or has been found to be indulging in unfair means or practices, NACIN may, after considering his representation, if any, declare him disqualified for the examination.
- Result (sub-rule 11). NACIN declares the results within one month of the conduct of the examination on the official websites of the Board, NACIN, the GST Council Secretariat, the common portal and the State Tax Department of the respective States or Union territories, if any; results are also communicated to applicants by e-mail and/or by post.
- Representation (sub-rule 12). A person not satisfied with his result may represent in writing, clearly specifying the reasons, to NACIN or the jurisdictional Commissioner as per the procedure established by NACIN.
- Power to relax (sub-rule 13). Where the Board or State Tax Commissioner considers it necessary or expedient, it may, on the recommendations of the Council, relax any provision of this rule with respect to any class or category of persons.
The Explanation to sub-rule (13) defines the "jurisdictional Commissioner" as the Commissioner having jurisdiction over the place declared as address in the application for enrolment; it refers to the Commissioner of Central Tax if the enrolling authority was selected as Centre, and to the Commissioner of State Tax if selected as State. The Explanation names the application form as "FORM GST PCT-1"; rule 83(1) names it FORM GST PCT-01. That is a drafting slip in the print; the two refer to the same application.
Annexure-A: pattern and syllabus
Annexure-A, which the rule refers to in sub-rule (7), prints the following for the paper "GST Law & Procedures":
| Item | As printed |
|---|---|
| Time allowed | 2 hours and 30 minutes |
| Number of Multiple Choice Questions | 100 |
| Language of questions | English and Hindi |
| Maximum marks | 200 |
| Qualifying marks | 100 |
| Negative marking | No negative marking |
The syllabus lists the Central Goods and Services Tax Act, 2017; the Integrated Goods and Services Tax Act, 2017; all the State Goods and Services Tax Acts, 2017; the Union territory Goods and Services Tax Act, 2017; the Goods and Services Tax (Compensation to States) Act, 2017; the Central Goods and Services Tax Rules, 2017; the Integrated Goods and Services Tax Rules, 2017; all the State Goods and Services Tax Rules, 2017; and notifications, circulars and orders issued from time to time under the said Acts and Rules. The qualifying marks of 200 maximum marks equal the fifty per cent. in sub-rule (8).

A worked example
Arjun Pillai, an invented person, was enrolled as a practitioner under rule 83(2) on the basis that he had been enrolled as a sales tax practitioner for not less than five years. Rule 83A applies to him. He registers online on the website NACIN specifies, pays the fee NACIN specifies and appears in the Computer Based Test. He scores below the qualifying marks, so he registers and pays again for the next sitting, since each attempt needs a fresh registration and fee. If a serious accident prevents him from one sitting, he writes to the jurisdictional Commissioner within thirty days of the conduct of that examination to ask for one additional attempt, which NACIN may consider on merits.
Points to watch
- Who is covered. Rule 83A(1) names only persons enrolled under clause (b) of rule 83(1).
- No amounts. The fee, its manner of payment and the schedule come from NACIN's announcements; the rule prints none.
- Fresh registration each attempt. Sub-rule (6)(iii).
- Additional attempt. It is a request, considered on merits, not a right.
- Rule 83B. Surrender of enrolment is separate: see rules 83B and 84.
