Section 536 Savings explained: this guide covers what it means, who it applies to, the step-by-step process, documents required, fees, due dates and penalties in India — so you can stay compliant with confidence and avoid costly mistakes.
The section 536 savings provision of the Income-tax Act, 2025 keeps a tax audit — or any proceeding — for a previous year governed by the 1961 Act under that Act, while a tax year governed by the 2025 Act is audited under section 63.
From the ICAI Guidance Note on Tax Audit (Revised 2026), which states in terms that it is the last edition of the Guidance Note on Tax Audit under section 44AB of the Income-tax Act, 1961.
What the Guidance Note actually says
At the end of chapter 13, immediately before the professional misconduct chapter, the Guidance Note records the transition in a single passage:
"This is the last edition of the Guidance Note on Tax Audit under section 44AB of the Income-tax Act, 1961. With effect from 1 April 2026, the Income-tax Act, 2025 has come into force and tax audits in respect of tax years governed by Income-tax Act, 2025, shall be governed by section 63. However, tax audit or any proceeding in respect of previous years governed by the Income-tax Act, 1961, shall continue to be governed by the relevant provisions of the Income-tax Act, 1961 by virtue of the repeal and saving provisions contained in section 536 of the Income-tax Act, 2025."
Three propositions come out of it, and the section 536 savings clause is what makes the third one work.
The three propositions
| Proposition | |
|---|---|
| 1 | The Income-tax Act, 2025 came into force on 1 April 2026 |
| 2 | Tax audits for tax years governed by the 2025 Act are governed by section 63 of that Act |
| 3 | A tax audit, or any proceeding, in respect of previous years governed by the 1961 Act continues under the 1961 Act — by virtue of the repeal and saving provisions in section 536 of the 2025 Act |
The section 536 savings language is not limited to the signing of a report. It covers any proceeding in respect of a 1961-Act previous year — assessment, appeal, penalty under section 271B, and a revision of the tax audit report under rule 6G(3). A revised report for a 1961-Act year is therefore still a Form 3CA/3CB with Form 3CD annexed, signed years after the 2025 Act came into force.
Which report goes with which year
| Year audited | Governing provision | Report and particulars |
|---|---|---|
| Previous year governed by the Income-tax Act, 1961 | Section 44AB, with Rule 6G of the Income-tax Rules, 1962 | Form No. 3CA or 3CB with Form No. 3CD annexed |
| Tax year governed by the Income-tax Act, 2025 | Section 63 | Form No. 26 under rule 47 of the Income-tax Rules, 2026 |
This is why no article in this cluster presents Forms 3CA, 3CB and 3CD as the going-forward position. The Guidance Note's own Preface makes the same point: this Eleventh Edition, incorporating the amendments made by the Finance Act, 2026, is intended to be the concluding edition under the 1961 Act, and members are advised to proactively familiarise themselves with the corresponding provisions of the Income-tax Act, 2025 and the Income-tax Rules, 2026 for tax audits pertaining to subsequent years. The Direct Taxes Committee will issue appropriate guidance on the new framework in due course.
What does not change with the Act
The same passage reminds members that it remains necessary to observe the responsibilities flowing from:
- the Act and Regulations;
- the Code of Ethics (2026); and
- the Standards on Auditing.
So the entire professional layer of the engagement survives the transition untouched — eligibility under the Council's decisions, the 60-audit ceiling under the Limit on Number of Tax Audits Guidelines, 2025, communication with the previous auditor, SA 210 engagement terms, SA 230 documentation, SA 530 sampling, SA 580 representations, UDIN, and the TAQRB's review remit. Only the statutory hook and the form change.
The practical overlap period
For a practice, the section 536 savings position means running two frameworks side by side for several years:
- Reports for 1961-Act previous years — including late filings, revisions under rule 6G(3), and reports produced during assessment or appeal — remain on Forms 3CA/3CB/3CD, and this Guidance Note remains the reference for them.
- Reports for 2025-Act tax years move to Form No. 26 under rule 47, and to whatever guidance the Direct Taxes Committee issues for the new framework.
- Templates, checklists and working paper packs therefore need to be versioned by year audited, not replaced.
Rule 47 renumbers far more than the audit report. Under the Income-tax Rules, 2026, Form 3CA/3CB/3CD becomes Form No. 26, Parts A to D; the medical daily case register in Form 3C becomes Form No. 25 under rule 46; and the reporting forms cited throughout Form 3CD — 3CEB, 3CEAC, 15CA/15CB, 10B/10BB and the rest — carry their own new numbers under the 2026 Rules. A clause-by-clause conversion is needed, not a find-and-replace on the form name.
Worked example
| Engagement, signed after 1 April 2026 | Governed by |
|---|---|
| Tax audit for the previous year ended 31 March 2026 | Section 44AB, Rule 6G — Form 3CA/3CB and 3CD |
| Revision of the report for the previous year ended 31 March 2025 after a section 43B payment | Rule 6G(3) — saved by section 536 |
| Section 271B penalty proceeding for the previous year ended 31 March 2024 | Income-tax Act, 1961 — saved by section 536 |
| Audit for the tax year governed by the Income-tax Act, 2025 | Section 63, rule 47 — Form No. 26 |
Audit checklist
- Identify, for every engagement, which Act governs the year being audited before selecting a form.
- Keep the Forms 3CA/3CB/3CD templates alive for saved years rather than retiring them.
- Treat revisions and appeals for 1961-Act years as governed by the old law under the section 536 savings.
- Build a form-number conversion map for 2025-Act years, clause by clause.
- Continue applying the Code of Ethics (2026), the SAs and the Council's guidelines unchanged across both frameworks.
- Watch for the Direct Taxes Committee's guidance on the new framework.
Common mistakes
- Filing a 1961-Act year on the new form because the report is being signed after 1 April 2026.
- Assuming the old Guidance Note is obsolete for saved years.
- Retiring the 3CA/3CB/3CD templates while revisions for earlier years are still possible.
- Treating the section 536 savings as covering only the report and not "any proceeding".
- Assuming the professional obligations lapse with the 1961 Act.
