Sections 45-I explained: this guide covers what it means, who it applies to, the step-by-step process, documents required, fees, due dates and penalties in India — so you can stay compliant with confidence and avoid costly mistakes.
Sections 45-I, 45K and 45L, inserted in 2023, say what the Co-operative Election Authority does, who actually runs the poll on the ground and what a society's board and staff must do when the Authority issues directions. This article states them as per the Ministry of Cooperation copy of the Act read with the Multi-State Co-operative Societies (Amendment) Act, 2023.
The Authority conducts the elections of multi-State co-operative societies, supervises, directs and controls the preparation of electoral rolls, and performs other prescribed functions (s.45-I). It may appoint a Returning Officer, observers and Assistant Returning Officers, and the Central Government must provide the staff and officers it needs (s.45K). By general or special order it may issue directions to the board, its members, the Chief Executive and other staff for fair elections, conducted without interference, and they shall comply (s.45L).
Printing note: "45-I"
The Act prints this section as "45-I" with a hyphen, while the next sections are 45J, 45K and 45L. We keep the printed form. Section 45J, which sits between 45-I and 45K, is explained in a separate note on elections of members of the board.
Context
The 2023 Amendment Act (Act 11 of 2023) came into force on 3 August 2023 by notification S.O. 3493(E). It substituted section 45 and inserted sections 45A to 45L. Nothing here existed in the principal copy. The sources do not say whether, or when, the Authority was established or began conducting elections. For a board that wants to prepare a timetable against these sections, our legal consultation team can help.
Section 45-I: functions of the Authority
"The Authority shall discharge the following functions, namely:"
- "conduct the elections of the multi-State co-operative society";
- "supervise, direct and control the matters relating to preparation of electoral rolls"; and
- "such other functions as may be prescribed."
The list is short but it moves two things away from the board: the conduct of the election and control over the electoral roll. Under the old section 45, the conduct of elections was the responsibility of the existing board. The text does not say how the Authority is to prepare or supervise the roll, or what "other functions" are; those are left to rules. Amendment rules were notified on 4 August 2023 (G.S.R. 591(E)); the consolidated Rules should be checked.
Section 45K: Returning Officer and other officers
Sub-section (1): the Returning Officer
"The Authority may appoint a Returning Officer to conduct the election of the multi-State co-operative societies and discharge such functions, as directed by the Authority, in such manner as may be prescribed." The appointment is discretionary ("may"), the Returning Officer acts on the Authority's direction, and the manner is left to rules.
Sub-section (2): staff
"The Central Government shall provide such staff and officers to the Authority as may be necessary for the efficient discharge of functions by the Authority under the Act." This is a duty on the Central Government, framed around necessity.
Sub-section (3): observers and Assistant Returning Officers
The Authority may appoint "(a) such observers as it may consider necessary to supervise the elections and discharge such other functions as may be prescribed; and (b) such number of Assistant Returning Officers as it may consider necessary to assist the Returning Officer." The number of each is for the Authority to decide.
Section 45L: directions to the board and staff
The Authority may, "by general or special order", issue such directions to the board, its members, Chief Executive and other staff of the multi-State co-operative society as may be necessary for the conduct of fair elections, conducted without interference, and the board, its members, Chief Executive and staff of the society "shall comply with such directions".
Points to note:
- the Authority may act by a "general" order that covers all societies or a "special" order for one;
- the direction must be "necessary for the conduct" of elections;
- the duty to comply is on the board, its members, the Chief Executive and staff, and is unqualified in the text;
- the section does not say what follows if directions are ignored. Related consequences appear elsewhere: section 43(2)(a), as amended, makes a person ineligible for five years if the board fails to provide the assistance the Authority requires. See our note on disqualifications for being a member of the board.
How the three sections fit with section 45J
Section 45J(9) separately requires the society in which an election is held to provide "such infrastructure, personnel, information, documents or other assistance to the Authority as it may require", and section 45J(8) requires the Chairperson and the Chief Executive to inform the Authority, six months before the expiry of the term of the existing board, "to conduct the elections within time". Section 45L adds a general power to give directions. Together they set up three layers: a duty to alert the Authority in time, a duty to assist it, and a duty to obey its directions.
A practical example
Shree Krishi Multi-State Co-operative Society is due for an election. Six months before the board's term ends, the Chairperson and the Chief Executive inform the Authority. The Authority appoints a Returning Officer and, because the society has branches in several States, two Assistant Returning Officers and an observer. It issues a special order to the board to hand over the register of members and to keep the premises open on polling day. The Chief Executive must comply. If the register were withheld, section 43(2)(a) is the provision a board would need to examine for its consequence of ineligibility.
What the 2023 Amendment Act changed
| Matter | Before (principal copy, old s.45) | After |
|---|---|---|
| Who conducts elections | "the existing board" (s.45(1)); the Central Registrar if the board failed (s.45(6)) | The Authority (s.45-I(i)) |
| Electoral rolls | Not addressed in the old section | Authority supervises, directs and controls their preparation (s.45-I(ii)) |
| Returning Officer, observers | Not provided | Authority may appoint (s.45K) |
| Directions to board and staff | Not provided | Authority may issue; board, members, Chief Executive and staff shall comply (s.45L) |
